Draft for Candidhive's private beta. The final version will name the company that runs Candidhive and will be reviewed by a lawyer before public launch.
Candidhive respects creators' rights. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA), and we disable accounts of repeat infringers in appropriate circumstances.
Report infringement
The fastest way is our online form. You can also send a written notice to our designated agent:
Your notice must include:
- Your physical or electronic signature (typing your full legal name counts).
- A description of the copyrighted work you believe was infringed.
- The link to each post or page on Candidhive with the material, so we can find it.
- Your name, mailing address, phone number and email.
- A statement that you have a good-faith belief that the use isn't authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
We'll remove or disable access to the material and tell the person who posted it, including a copy of your notice with your name and email (but not your phone number or address) so they can contact you or respond. Before sending a notice, consider whether the use might be fair use or licensed: under the DMCA (17 U.S.C. § 512(f)), anyone who knowingly misrepresents that material is infringing may be liable for damages.
If your content was removed
We'll notify you in the app and by email. If you believe it was removed by mistake or misidentified (for example, you own it, have a license, or it's fair use), you can send a counter-notice from the link in that notification. It must include your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and phone number; a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the United States, any judicial district where Candidhive may be found); and that you'll accept service of process from the person who sent the notice or their agent.
We'll forward your counter-notice to the person who sent the original notice. If they don't tell us within 10 business days that they've filed a court action to keep the material down, we'll restore it within 10 to 14 business days after we received your counter-notice.
Repeat infringers
Each valid notice that leads to removal counts as a strike on the account. Accounts that receive three strikes are suspended. Strikes from notices that are withdrawn or successfully countered are removed.
