Terms of Service

Draft for Candidhive's private beta. The final version will name the company that runs Candidhive and will be reviewed by a lawyer before public launch.

These terms are an agreement between you and Candidhive ("Candidhive", "we", "us"). They cover candidhive.com, the Candidhive app, and everything you do on them. By creating an account or using Candidhive, you agree to these terms, our Privacy Policy, our Copyright Policy, and the community rules. If you don't agree, don't use Candidhive.

1. Who can use Candidhive

You must be at least 18 years old, able to form a binding contract, and not barred from using Candidhive under the law that applies to you. If you use Candidhive for a business, you confirm that you're allowed to accept these terms for that business, and "you" includes the business.

2. Your account

Give accurate information and keep it up to date. One person, one personal account; brands may have one account per brand. You're responsible for what happens in your account, so keep your email, passkeys and authenticator app secure. Tell us right away at hello@candidhive.com if you think someone else got into your account. You can't sell, rent or transfer your account or username.

3. Your content

You own what you post. Photos, videos, captions, comments and messages you share ("your content") stay yours.

The permission you give us. So we can run Candidhive, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize, transcode, display and distribute your content, only to operate, secure and improve Candidhive and to show it to the people you choose (for example, connections only, everyone on Candidhive, or the public). This includes showing previews of public posts when someone shares a link. We won't use your content in our advertising without asking you first. The license ends when you delete the content or your account, except for copies kept for a limited time in backups, copies others already shared (such as reposts of public posts or messages someone received), or copies we must keep for legal or safety reasons.

You're responsible for your content. Only post content you created or have the rights to use, including the rights of anyone who appears in it. If you post content made for a brand, follow the terms you agreed with that brand.

AI and edited media. Don't present AI-generated or digitally created people, voices or results as real. If content is substantially AI-generated or altered in a way that could mislead, say so.

5. Brands, creators and deals

Candidhive helps brands and creators find each other, agree on work, and share drafts. Campaigns, applications, offers and deals are agreements between the brand and the creator. Unless a feature clearly says Candidhive holds the payment, Candidhive isn't a party to those agreements, doesn't employ creators, and doesn't guarantee that anyone will pay, deliver, or meet a deadline.

6. Ads and disclosures

If a brand paid you, gave you a free product, or has any other material connection to you, turn on "Paid partnership" so the Ad label shows, and follow the U.S. Federal Trade Commission's Endorsement Guides and similar laws where you and your audience are. Brands must not ask creators to hide a connection.

7. Payments, Pro and fees

Payments are processed by Stripe; card details go to Stripe, not to us. Prices are shown before you pay and may include taxes where required.

8. ID verification

You can verify your identity through Stripe. The verified badge means Stripe matched a government ID to a live selfie and confirmed the person is 18 or older at the time of verification. It isn't an endorsement and doesn't guarantee who is behind an account later or how someone will behave. Each person may verify one account. Accounts found to be run by someone under 18 are suspended.

9. Public pages

Your profile has a public page (candidhive.com/@yourname) that anyone, including search engines, can see. It shows your profile and only the posts you mark "Public". You can turn it off in Settings. Search engines may keep copies for a while after you change or remove something; we can't control that.

We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act. See our Copyright Policy to send a notice or a counter-notice. We disable accounts of repeat infringers in appropriate circumstances.

11. Safety and enforcement

We may review, limit, remove or hide content, and warn, limit, suspend or close accounts, if we believe they break these terms or the law, put people at risk, or expose Candidhive to legal risk. When we can, we'll tell you why and how to appeal by emailing hello@candidhive.com. We may keep information and share it with law enforcement where the law requires or allows, including reports to NCMEC. We aren't obligated to monitor content, but we may use tools and reports from members to find content that breaks these terms.

12. Ending your account

You can delete your account anytime in Settings. Download your data first if you want a copy. When you delete it, your profile, posts and comments are removed; messages you sent may remain visible to the people who received them, and we keep some records as described in the Privacy Policy. Sections 3 (limited survival), 5, 7 and 13–16 continue after your account ends.

13. Disclaimers

Candidhive is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that Candidhive will always be available, secure or error-free, or that any member, campaign, deal or content is accurate, safe or lawful. Some places don't allow these disclaimers, so they may not all apply to you.

14. Limits on liability

To the fullest extent the law allows, Candidhive and its owners, employees and service providers won't be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to Candidhive or these terms, even if we were told they were possible. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100. These limits don't apply where the law doesn't allow them, such as for fraud or for injury caused by our gross negligence or willful misconduct.

15. Indemnity

If someone makes a claim against us because of your content, your deals with other members, or your breach of these terms or the law, you'll defend and pay for the claim (including reasonable legal fees), to the extent the law allows. We'll tell you about the claim and let you take part in the defense.

16. Disputes and governing law

Please contact us first at hello@candidhive.com. Most problems can be solved that way, and we'll try in good faith for 30 days before either of us goes to court. These terms are governed by the laws of the State of Georgia and applicable U.S. federal law, without regard to conflict-of-law rules. Any lawsuit must be brought in the state or federal courts located in Georgia, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where eligible. If you're a consumer in a country or state that gives you the right to bring claims in your local courts or under your local law, nothing here takes that right away.

17. Changes

We may update these terms as Candidhive changes. If a change is significant, we'll tell you in the app or by email before it takes effect, and we'll ask you to accept the new version the next time you use Candidhive. If you don't agree, you can delete your account.

Other terms: if any part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given up the right to. You can't transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These terms, with the policies linked above, are the whole agreement between us about Candidhive.
